There is the one year court rule. This provides that a party with standing to redeem the tax lien may file a motion to vacate the final judgment up and until one year from the date of entry of the final judgment. In this situation, the moving party would have to show something was either wrong with the sale of the tax lien or something was wrong with the foreclosure. An example would be the taxes were paid and the municipality sold the lien due to some kind of mistake. With regard to the foreclosure an example would be that Current Owner believed he served the defendant properly, but they can show that was not the case (for instance someone at the address accepted serviced and the defendant can show they were out of the country). The buyer therefore is assuming a risk if the title company does list the one year rule in this case as an exception on the title policy because the title company will not defend against a motion to vacate the FJ under the one year rule.
